1. acknowledgment of risks and informed consent

You acknowledge that all dermal, lymphoedema, and related treatments carry inherent risks, including but not limited to:

• Allergic reactions
• Skin irritation or bruising
• Infection
• Swelling or pain
• Unsatisfactory aesthetic or functional outcomes
• Rare but serious complications (e.g., vascular issues, nerve damage)

You confirm that you have been fully informed about the proposed treatment, its benefits, risks, alternatives, and costs. It is your responsibility to disclose all relevant medical history, current medications, allergies, pregnancies, or other conditions that may affect safety or outcomes. Failure to disclose accurate information may void any protections under this agreement and increase your personal risk.

2. hold harmless and indemnity

To the fullest extent permitted by law, you agree to release, hold harmless, and indemnify Lipedema Lab, its directors, employees, contractors, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your treatment or any procedure performed
• Any adverse reaction, complication, or outcome
• Your failure to follow pre- or post-treatment instructions
• Any pre-existing condition not disclosed

This release applies even if the claim alleges negligence on our part, except where prohibited by Australian Consumer Law (e.g., no exclusion for gross negligence or wilful misconduct).

3. limitation of liability

Under no circumstances will Lipedema Lab be liable for:

• Indirect, consequential, incidental, or punitive damages
• Loss of income, opportunity, or emotional distress
• Any amount exceeding the fees paid for the specific treatment giving rise to the claim

Our total liability is limited to re-performing the service or refunding the treatment fee, at our discretion.

4. client responsibilities

You agree to:

• Provide accurate and complete health information
• Follow all pre-treatment preparation and post-treatment care instructions
• Attend follow-up appointments as recommended
• Immediately report any concerns or adverse effects
• Seek independent medical advice if desired before proceeding
• Arrive on time for appointments and provide at least 48 hours' notice for cancellations (late cancellations or no-shows may incur a fee of up to 50% of the treatment cost)

5. practitioner qualifications and standards

All treatments are performed by qualified and experienced dermal clinicians and lymphoedema therapists registered with relevant Australian professional bodies. We comply with infection control standards, use only TGA-approved products/devices, and maintain appropriate professional indemnity insurance.

6. photographs and records

With your separate written consent, clinical photographs may be taken for your medical record, treatment planning, or (anonymously) for training/education. You may withdraw consent for secondary uses at any time.

7. fees and payment

• We are a private billing clinic.
• Full payment is required at the time of service unless prior arrangements are made.
• Prices are subject to change without notice; you will be quoted at booking.
• No refunds for change of mind; refunds for other reasons are at our discretion.

8. governing law

These terms are governed by the laws of Queensland and the Commonwealth of Australia. Any disputes will be resolved in Queensland courts.

9. acceptance of terms

By proceeding with any service, you confirm that you:

• Are 18 years or older (or have parental/guardian consent if under 18)
• Have read, understood, and voluntarily accept these terms of engagement
• Enter this agreement freely and without duress

10. Changes to Terms

We may update these terms from time to time. The current version is always available on our website and at reception. Continued use of our services constitutes acceptance of any updates.
